Terms of Service

Last updated: June 19, 2026 · Effective date: June 19, 2026

1. Agreement to Terms

These Terms of Service ("Terms") govern your use of Aira, a product of i Rise Up, LLC ("Aira," "we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

2. What Aira Is — and Is Not

Aira helps you record healthcare visits, receive a plain-language explanation of what was discussed, and prepare follow-up questions.

Aira is not a medical device, and it does not provide medical advice, diagnosis, or treatment. Aira's explanations are intended to help you understand and remember your visit — they are not a substitute for your doctor's judgment, your official medical record, or professional medical advice. Always follow the instructions of your healthcare provider, and seek immediate medical attention for any urgent or emergency concern.

3. Recording Your Visit — Your Responsibility

When you use Aira to record a healthcare visit, you are solely responsible for complying with all applicable recording consent laws in your state, province, or country. Some jurisdictions require that all parties to a conversation be aware that it is being recorded. We recommend informing your healthcare provider before recording.

Aira provides the technology to record and process audio; Aira does not record on your behalf, does not verify consent, and is not a party to the conversation being recorded. You agree that you are making the decision to record, and that you bear responsibility for that decision and its legality.

[Note for legal review: confirm final language and consider whether an explicit in-product consent acknowledgment/checkbox should be required before first use, in addition to this Terms provision.]

4. Eligibility

You must be at least 18 years old to create an Aira account. If you are using Aira on behalf of, or to assist, another person (such as a parent or care recipient), you represent that you have the authority to do so.

5. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us promptly at support@airamed.org if you believe your account has been accessed without authorization.

6. Acceptable Use

You agree not to:

7. Accuracy of Explanations

Aira's explanations are generated using AI-based language processing grounded in established medical sources. While we strive for accuracy, Aira's explanations may contain errors or omissions and should not be relied upon as a complete or authoritative substitute for your doctor's guidance or your official medical record. If anything in your Aira explanation seems unclear or inconsistent with what you understood from your provider, please follow up directly with your healthcare provider.

8. Fees and Payment

Certain features of Aira may be offered free of charge, while others may require payment, as described within the Service at the time of purchase. We will clearly disclose any fees before you are charged. [Note for legal review: insert specific billing, cancellation, and refund terms once pricing model is finalized.]

9. Intellectual Property

The Service, including its design, text, graphics, and underlying technology, is owned by i Rise Up, LLC and protected by applicable intellectual property laws. You retain ownership of the recordings and content you submit, and you grant us a limited license to process that content solely to provide the Service to you.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. AIRA DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY EXPLANATION GENERATED BY THE SERVICE WILL BE ACCURATE OR COMPLETE.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, AIRA AND I RISE UP, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, ARISING FROM YOUR USE OF THE SERVICE. [Note for legal review: insert jurisdiction-appropriate liability cap and confirm enforceability given health-related subject matter; consider whether a higher standard of care language is needed given the patient population served.]

12. Indemnification

You agree to indemnify and hold harmless Aira and i Rise Up, LLC from any claims, damages, or expenses arising from your violation of these Terms or your violation of any applicable recording consent law. [Note for legal review: confirm scope and mutuality of this clause.]

13. Termination

You may stop using the Service at any time. We may suspend or terminate your access to the Service if you violate these Terms or if we reasonably believe doing so is necessary to protect the Service, other users, or any third party.

14. Governing Law

These Terms are governed by the laws of [STATE — to be finalized], without regard to its conflict-of-laws principles. [Note for legal review: confirm governing state and whether arbitration/venue clauses should be added.]

15. Changes to These Terms

We may update these Terms from time to time. We will post the updated Terms here with a new "Last updated" date. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
